Terms of Use

These terms apply to the Nubi iPhone app (“the app”) and the website trynubi.com. By downloading or using the app you agree to them. “Nubi”, “we” and “us” mean Van Nguyen Dang, an individual developer based in Vietnam and the developer of record for Nubi on the App Store.

1. The app

Nubi is a bedtime companion and alarm. We grant you a personal, non-transferable license to use the app on Apple devices you own or control, under these terms and Apple’s Licensed Application End User License Agreement. If these terms and Apple’s agreement conflict, these terms apply to the extent allowed.

2. Nubi Plus subscription

• Price. Nubi Plus is an auto-renewing yearly subscription priced at 29.99 USD per year. Prices in other currencies are set by the App Store and shown before you confirm the purchase, and may include local taxes.
• Free trial. Eligible new subscribers get a 7-day free trial. If you don’t cancel at least 24 hours before the trial ends, the yearly subscription starts automatically and you are charged. Any unused part of a free trial is forfeited when you buy a subscription.
• Payment. Payment is charged to your Apple ID account when you confirm the purchase, or when the free trial ends.
• Auto-renewal. The subscription renews automatically for another year unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours before the end of the current period, at the then-current price. If the price ever goes up, Apple will tell you and, where required, ask for your consent first.
• Managing and cancelling. You can manage or cancel your subscription in your iPhone’s Settings → [your name] → Subscriptions, or in the App Store account settings. Cancelling stops the next renewal; you keep Plus until the end of the period you already paid for.
• Refunds. Purchases are processed by Apple, so refund requests are handled by Apple under its policies (reportaproblem.apple.com). We cannot issue refunds ourselves.

3. Not a medical device

Nubi helps you build a calmer bedtime routine. It is not a medical device and does not diagnose, treat or monitor any sleep disorder or health condition. Sleep times and peek counts are estimates based on how you use your phone. If you have concerns about your sleep, talk to a doctor.

4. Alarms

Nubi uses Apple’s AlarmKit so the alarm can ring in Silent and Focus modes. Alarms still depend on your device being on, charged and working normally, on your iOS settings and on iOS itself. Please keep a backup for wake-ups that really matter, such as flights or medication.

5. Fair use

Please don’t copy, resell, reverse-engineer or misuse the app or the website, or try to interfere with how they work, except where the law allows it.

6. Our content

Nubi, the Nubi character, its animations, artwork, sounds and the app’s design belong to us or our licensors. These terms don’t give you any rights to them beyond using the app.

7. The waitlist

Joining the waitlist is free and doesn’t commit you to anything. Launch dates and features described on the website are our current plans and may change. See the privacy policy for what we store.

8. Disclaimers and liability

We work hard to make Nubi reliable and kind, but the app is provided “as is”. To the extent the law allows, we are not liable for indirect or consequential losses, such as oversleeping or a missed appointment, and our total liability to you is limited to the amount you paid for Nubi Plus in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.

9. Changes and ending

We may update the app and these terms. If a change is significant, we will tell you in the app or on this page before it takes effect. You can stop using Nubi at any time by deleting the app and cancelling any subscription. We may suspend access if these terms are seriously broken.

10. Apple

These terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide support for it, and is a third-party beneficiary of these terms with the right to enforce them against you.

11. Governing law

These terms are governed by the laws of Vietnam. If a dispute cannot be settled by writing to us first, it goes to the competent courts of Vietnam. Nothing here takes away the consumer rights your own country gives you, and where that law says a different court or law applies to you, that applies instead.
